Provider agreement
Accepted when the provider side of your account is activated.
1. Purpose and self-employed status
This agreement governs the relationship between you (the "provider") and heysimone.ca when you activate the provider side of your account. By activating it, you acknowledge that you have read, understood and accepted all of these terms, in addition to the platform’s general Terms of use.
You act as an independent self-employed worker (or as a business), on your own account. heysimone.ca is not your employer, nor a principal, nor a placement agency within the meaning of the applicable Quebec and Canadian laws. heysimone.ca does not direct your work, does not set your rates and is not a party to the visits you carry out for families.
2. Monthly membership
Access to the provider side is offered as a monthly membership of $9.95 (plus taxes where applicable), payable each month with the payment method on file in your account. An annual plan at a reduced rate may be offered; if it is, its terms are shown at the time of purchase.
First three months free: the membership is free for the first 3 months of each provider, counted from the official launch of the platform or, if it comes later, from the activation of their profile. The membership of $9.95 per month applies from the 4th month on.
The membership renews automatically each month for as long as the provider side of your account stays active. You may turn off the renewal at any time from your account; the membership then stays valid until the end of the period already paid for.
3. Verification fee
To obtain and keep the "Verified heysimone.ca" mark, a verification fee applies, as a single payment due when your account is created. The amount in force is shown at the time of payment.
This fee covers the identity and criminal-record check carried out by an accredited firm. heysimone.ca also runs random and periodic checks on its providers, and may require a new verification at any time. You undertake to notify heysimone.ca without delay of any charge, indictment or conviction, or of any other change in your criminal record status arising after you registered. The verification program is set out in detail in the Terms of use.
4. Platform fee (commission)
In return for the matching, scheduling and handling of payments, heysimone.ca charges a platform fee equal to a percentage of the provider’s rate (as a guide, 20% at launch), which may vary with your level of activity.
The GST (5%) and the QST (9.975%) apply to that platform fee and appear on the invoice heysimone.ca issues to the family.
5. Non-circumvention of the platform
Any relationship begun through heysimone.ca must continue on the platform. You undertake NOT to circumvent heysimone.ca — that is, not to arrange, schedule, invoice or collect payment for services directly, off the platform, with a family or a senior met through heysimone.ca, in order to avoid the platform fee.
This obligation applies for the entire term of your account and for a period of twelve (12) months following the last contact established, through the platform, with a given family or senior.
Circumvention directly harms the platform that makes the match possible (verification, safety, payments, support). In the event of a breach, heysimone.ca may, at its discretion and in accordance with the applicable laws: suspend or terminate your access, withdraw the "Verified" mark, and claim the platform fees evaded, without prejudice to any other remedy.
6. Payments and payouts
Payments pass through our payment provider (Stripe Connect). You must complete your Stripe setup before you can accept visits and receive your payouts.
You receive 100% of your hourly rate for the time actually worked. The payout is triggered automatically 48 hours after the end of the visit, through Stripe, unless a report from the family is under review. Where it applies, the annual platform fee of $25 (plus taxes) is withheld from your payouts until it is recovered in full.
7. Tax obligations
As a self-employed worker, you alone are responsible for your tax obligations: reporting your income and, where it applies, registering for, collecting and remitting the GST and the QST on the services you deliver to families. heysimone.ca neither collects nor remits those taxes on your behalf.
heysimone.ca makes statements of your transactions available to you to make your bookkeeping easier, without this amounting to tax advice.
8. Your commitments
You declare that you are at least 18 years old. You undertake to: supply accurate and up-to-date information; deliver your services with competence, diligence and respect; respect the dignity, safety and privacy of seniors and the people close to them; hold the qualifications required for the regulated services you declare you offer; and comply with all applicable laws.
As a self-employed worker, you remain responsible for the services you offer and for their proper delivery. heysimone.ca acts as a technological intermediary that connects people, and does not take part in carrying out the visits.
You attest that you have no criminal record incompatible with the services offered, and you undertake to notify heysimone.ca without delay of any change in your criminal record status (see section 3).
9. Cancellation, absence and conduct
A late cancellation on your part, an absence (a "no-show") or conduct that does not comply may lead to a penalty, to lower visibility, or to the suspension or withdrawal of the "Verified" mark, according to the platform’s settings.
heysimone.ca may, at its discretion and in accordance with the applicable laws, suspend or withdraw your access to the provider side in the event of a report, a breach, fraud, non-compliance or a risk to families.
10. Termination
You may deactivate the provider side of your account at any time from your account; your account (the family side) stays active. Amounts owing (deferred fees, visits in progress) remain payable.
Membership and verification fees already paid are not refundable, except where a mandatory provision of the law requires otherwise.
11. Liability and governing law
To the fullest extent permitted by law, heysimone.ca disclaims all liability for the acts, omissions or fault of providers and for damage resulting from the services delivered. This agreement supplements the Terms of use and the Privacy policy, which apply in full.
This agreement is governed by the laws of Quebec and by the applicable Canadian laws.
This English text is a translation, provided so this agreement can be read in English. The French version of this agreement is the official one and prevails in the event of any discrepancy.
